On August 8, 2024, the Governor of Puerto Rico signed Act 140-2024 to amend subsection (d) of Section 7.035 of Act 107-2020, known as the “Municipal Code”, in order to prohibit the denial or revocation of the tax exemption of a residential property when its owner or his family moves out of the same to assist and provide care to a family member over (60) sixty years of age who is suffering from a critical illness. On the other hand, said prohibition shall also apply when the family member in need of assistance must move out of his or her residence, provided that in both cases the residence is not rented.
The Municipal Revenue Collection Center shall amend its regulations for these purposes and shall publicize the same.
However, the law also establishes that the person acting as caregiver is required to file an affidavit stating: Name, personal circumstances and identify the residential property in their name, establish the relationship with the relative and that they are acting as caregiver of a relative aged sixty (60) years or older; or that they are caring for a relative who is affected by a critical illness and requires assistance and care; or is a relative with a handicap condition that requires assistance.
This measure will help the burden of family members who serve as caregivers and are forced to travel both within and outside of Puerto Rico to provide the same to their loved ones.
